1. Introduction

1.1 Agreement Overview

These Terms of Service ("Terms") constitute a legal agreement between you and Digio Gram ("we," "our," or "us"), doing business as Gramaivoice. Your use of gramaivoice.com (the "site") and related services (collectively, the "Services") is subject to these Terms. By downloading, installing, accessing, or using our Services, you:

• Acknowledge that you have read and understood these Terms
• Agree to be bound by these Terms
• Agree to our Privacy Policy (available at /privacy-policy)
• Commit to comply with all applicable laws and regulations

If you do not agree with these Terms, you must not use our Services.

1.2 Definitions

"Site" refers to our website and associated tools for audio generation.
"Content" means text, audio, projects, data, files, and other materials that you create, modify, or access through our Services.
"User" means any individual who accesses or uses our Services.
"Authorized User" means a User who is authorized by you to access and use the Services under your account.
"Input" means the text prompts, commands, and instructions you provide to the Services.
"Output" means the audio, responses, and other content generated by the Services based on your Input.

2. License to Use Our Services

2.1 Rights Granted

Subject to your compliance with these Terms, Gramaivoice grants you a limited, personal, non-exclusive, non-transferable license to access and use our Services for their intended purpose.

• Free Plan: Limited to personal, non-commercial use unless otherwise specified.
• Paid Plans: May be used for commercial purposes according to the terms of your subscription.

2.2 Restrictions

You may not, and you may not permit others to:

• Distribute, sell, rent, lease, or sublicense our Services (the platform itself, not the content generated under paid plans).
• Remove or alter any proprietary notices or labels on our Services.
• Use our Services in a way that could harm, disable, overburden, or impair our systems.
• Use automated scripts to collect information from or interact with our Services.
• Use our Services for any illegal purpose or in violation of any applicable laws.

2.3 Reservation of Rights

All rights not expressly granted to you in these Terms are reserved by Digio Gram. You acknowledge that you do not acquire any ownership rights in the Services software by using them.

3. User Accounts and Content

3.1 Account Creation and Management

• You may be required to create an account to use certain features.
• You must provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

3.2 Minimum Age

You must be at least 13 years old to use the Service. Users under 18 require parent or guardian consent.

3.3 Account Deletion

You may request deletion of your account by contacting contact@digiogram.com. Upon deletion, your access and content will be removed.

3.4 User Content & Ownership

You retain ownership of the Input you provide. For Output (generated audio):

• Paid Users: You own the commercial rights to the generated audio.
• Free Users: You are granted a license for personal use only.

3.5 Usage of Your Content

You grant Gramaivoice a license to process, store, and display your Content as necessary to provide the Services. We do not sell your Content.

4. Services and Pricing

4.1 Plans and Limits

We offer various subscription plans. Current details are available at /pricing. Each plan has specific limits (e.g., character counts, voice access). We reserve the right to modify plans and pricing.

4.2 Subscription and Payment

• Service is subscription-based (monthly/yearly) or credit-based.
• Subscriptions automatically renew unless canceled.
• Payments are generally non-refundable unless specified.

4.3 Refund Policies

All payments are non-refundable unless otherwise determined by us. Refunds may be considered for billing errors or duplicate charges at our sole discretion. TAT for approved refunds is 14 days.

4.4 Cancellation

You can cancel subscriptions at any time via your Dashboard. Access continues until the end of the billing period.

5. Acceptable Use

You agree not to use our Services to create or process Content that:

• Is unlawful, harmful, threatening, abusive, or harassing.
• Is defamatory, vulgar, obscene, or otherwise objectionable.
• Promotes illegal activities or violates third-party rights.

6. Intellectual Property

Digio Gram owns all rights to the "Gramaivoice" brand, platform, logos, and underlying technology.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGIO GRAM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OF THE SERVICES. A TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.

9. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be resolved in the courts of India contextually appropriate to Digio Gram's registered location.
